• All prices quoted ex nursery excluding Value Added Tax at British rates applicable at the time of purchase.All plants are sold as per our terms of sale or as agreed by customer.
• Liners :- A minimum of not less than 18 per variety is required. A minimum order of less than 500 (approximate number per Danish trolley) plants cannot be accepted unless the customer is able to collect.
  
• Rooted cutting Plugs :- A minimum of not less than 100 per variety is required. A minimum of less than 1600 (approximate number per Danish trolley) plugs cannot be accepted unless the customer is able to collect.
• Approved accounts are due for settlement within 30 days. Payment of invoices will be required in pounds sterling, either by inter-bank transfer or by sterling cheque drawn from a UK bank.
• Provided payment is made within 30 days, discount at the following rates may be deducted:
  Cash on collection (£300.00 and over) - 5%
  Total annual order (from 1st February to 31st January) value over £2500.00 - 2.5%
  Total annual order (from 1st February to 31st January) value over £5000.00 - 5%
• All new customers will be asked to submit a 20% deposit prior to delivery of their order and will be requested to complete a credit application form, also satisfactory trade references must be provided.
• We reserve the right to charge interest at the rate of 3% above Barclays Bank plc current base rate on all overdue accounts.
• We reserve the right to charge for all solicitors/accountants fees and court costs that may be incurred in recovering any monies owed to West End Nurseries (Newton Abbot) Ltd.
• We reserve the right to withhold further deliveries until outstanding accounts have been settled in full.
• In the event that the customer cancels their order (whole or in part) prior to delivery West End Nurseries (Newton Abbot) Ltd reserves the right to and shall be entitled (without prejudice to any other rights) to charge an additional sum to cover costs incurred by it up to date of cancellation.
• Packing is charged at cost £1 per cardboard box. No charge for packing on consignments over £1500. Returnable em-pot trays charged at £1.
• Carriage by carrier and where possible within 400 miles mainland at 10% or at cost or by special arrangement. Consignments over £1500 will be supplied free of charge. A minimum charge of £50 for each Danish trolley and £25for box consignments will be made for packing and delivery.
• In the case of losses claims can only be entertained if submitted in writing within seven days after arrival, also we shall not be liable for any damage due to transport losses caused as a result of any occurrence or circumstances outside its control. Customers should always inspect plants at the time of collection or arrival. Plants are supplied true to name so far as can be ascertained, if an error has been made liability towards damages or compensation for breach of contract shall not exceed the invoice price of the goods in question.
• Acceptance of telephone orders after written confirmation by letter, fax or email.
• This list cancels all previous price lists and/or terms of sale.
• An offer is subject to being unsold on receipt of an order and to satisfactory growth of crop after an order has been confirmed. We reserve the right to alter pot size of the liner at time of supply.
• Although risk in goods passes to the buyer upon the goods leaving the nursery, legal title to the goods will not pass to the customer until payment in full is received. The customer shall hold goods as bailee only until full payment is made and legal title is transferred.
• If the customer shall commit any act of insolvency, West End Nurseries (Newton Abbot) Ltd shall thereupon be entitled forthwith to terminate the contract for the sale of the items referred to in the invoice/order by written notice to the customer without prejudice to any rights it may have against the customer.
• The sale of any item referred to in the invoice shall be governed by and construed in accordance with English law.
• We reserve the right to uplift goods supplied if payment is not received after one months notice has been given.
• Customers requiring plant health certificates will be charged at cost.

The customer (to be the person, firm or company) is understood to agree with these terms of sale.
